Las Instituciones Nacionales de Derechos Humanos cumplen, fundamentalmente, con dos funciones: proteger a las personas a partir de recomendaciones, garantizándoles una reparación si se comente una violación a sus derechos, y prevenir futuras violaciones a los derechos humanos. Sobre esta base están llamadas a ser los organismos que guíen hacia una cultura ciudadana a favor de los derechos humanos. Para lograr la culturización en este campo, se requiere educar en derechos a través de la educación formal e informal. En el (...) caso de México, la Comisión Nacional de los Derechos Humanos es la institución encargada de realizar esta labor. Su posición flexible y dinámica, así como su autonomía dentro del Estado mexicano, le dan la posibilidad de propiciar esa cultura, ya que es una institución de configuración diferente al sistema tradicional de impartición de justicia, por lo que hace que mantenga una línea de investigación enfocada en los derechos humanos. La culturización empieza por el ámbito nacional o interno y se debe extender hacia el exterior, como un movimiento social internacional. (shrink)

In order to clarify whether Rawls is more or less cosmopolitan than Kant, we carry out a comparative analysis between his general proposals for the organization of international relations. Likewise, seeking to clarify the distance between cosmopolitanism, pacifism and ius internationalism, the ius ad bellum proposals of both authors are particularly analyzed in the war-and-peace debate context. On the one hand, as a result of the first analysis, different commonly unnoticed logical coincidences between the postulates of Kant and Rawls are (...) highlighted. On the other hand, after the conclusions of the second analysis and taking as a criterion the causes that both authors admit as just for war, a proposal of an ideal type of cosmopolitan ius ad bellum is also provided. María José Rincón González nació en Sevilla (España) y reside en República Dominicana desde 1992. Es miembro de número de la Academia Dominicana de la Lengua (ADL) desde el 2011 y directora del Instituto Guzmán Ariza de Lexicografía. Asimismo, es miembro correspondiente de la Real Academia Española (RAE) y miembro del consejo asesor de Fundéu Guzmán Ariza. Con respecto a su formación superior, es doctora en Filología por la Universidad Nacional de Educación a Distancia (UNED) y máster en (...) Lexicografía por la Universidad de Sevilla y la UNED. Ha participado en congresos internacionales y ha contribuido en las ediciones de diccionarios del idioma español. En aquest article pretenem fer una crítica, des de postulats ètics de caràcter republicà, al mode actual d’entendre i, per tant, posar en pràctica el principi d'autonomia de la bioètica. Pretenem mostrar que, en l’estat actual d’aplicació d'aquest principi, emprant una definició liberal de llibertat i de la natura humana, aquest idea de llibertat i autonomia que es pretén protegir, no es compleix en deixar fora de l’equació tot un seguit de circumstàncies socials, polítiques o econòmiques que poden dificultar al (...) pacient prendre una veritable decisió sobirana sobre quin ha de ser el fet d'actuar dels professionals sanitaris sobre el seu cos en cada cas. En el artículo se ofrece un análisis crítico de la misión como inculturación del Evangelio, desde una perspectiva filosófico-teológica. Para comenzar, se exponen las deficiencias de la evangelización colonizadora en América. Posteriormente, se proponen dos posibles sentidos de la plantatio ecclesiae como meta de la misión. En tercer lugar, se esclarece la manera en la que se entiende la relación entre Evangelio y cultura en la Nueva Evangelización. Se examina la idea de un vínculo directo entre modernización y pérdida de plausibilidad de la creencia religiosa, se explora la imagen contemporánea de la relación entre religión y racionalidad, y se muestra cómo no puede afirmarse que el avance de la ciencia conduzca a la secularización. Ante la pregunta, si la postsecularización conlleva una mutua exclusión de religión y racionalidad, se examinan las propuestas de J. Habermas y N. Wolterstorff, buscando criterios normativos para el diálogo entre racionalidades religiosas y (...) no religiosas. The article examines the idea of a direct link between modernization and the loss of plausibility of religious belief, explores the contemporary image of the relation between religion and rationality, and shows why it is not possible to say that the advance of science leads to secularization. In view of the question regarding whether post- secularization entails the mutual exclusion of religion and rationality, it examines the proposals of J. Habermas and N. Wolterstorff, in a search for normative criteria for the dialogue between religious and non-religious rationalities. (shrink)

Se explora la relación entre las dimensiones proposicional y no proposicional de la creencia religiosa para mostrar que la última dirige el proceso de justificación y representa su límite. Se defiende que la no proposicional también tiene valor cognitivo, porque constituye una suerte de elección epistémica preteórica que no es exclusiva de la fe religiosa. Se explora la noción de ambigüedad religiosa, tanto a nivel intelectual como experiencial, y se sostiene que la relación entre la dimensión proposicional y la no-proposicional (...) de la fe está mediada por la función directiva de las presuposiciones metafísicas instauradas por la experiencia religiosa. This paper argues that there is a thread in the philosophy of E. Tugendhat binding together his moral and justice theories with his conceptual analysis. Oriented by the thesis that a conceptual analysis is necessary to explain what justice is, this paper reconstructs some aspects of Tugendhat’s philosophy. It is divided in four sections: First, I delve into the author’s definition and use of conceptual analysis. Second, I describe some features of Tugendhat’s moral theory of contractualism. Third, I examine his (...) theory of justice. Fourth, I conclude by framing my analysis within the debate between Rawls’s and Tugendhat’s theories of justice. (shrink)

This paper argues that the historical character of our knowledge is compatible with both ontological and epistemological realism. The first part critically analyses the thesis according to which the situated nature of our cognitive practices implies that they do not refer to an extra-linguistic reality. The second section explores the claim that realism is a necessary presupposition of our communicative practices and the final part outlines the principles of a pluralist realism.

The past decade has seen an explosion of work on calculi of explicit substitutions. Numerous works have illustrated the usefulness of these calculi for practical notions like the implementation of typed functional programming languages and higher order proof assistants. It has also been shown that eta-reduction is useful for adapting substitution calculi for practical problems like higher order unification. This paper concentrates on rewrite rules for eta-reduction in three different styles of explicit substitution calculi: λσ, λse and the suspension calculus. (...) Both λσ and λse when extended with eta-reduction rules, have proved useful for solving higher order unification. We enlarge the suspension calculus with an adequate eta-reduction rule which we show to preserve termination and confluence of the associated substitution calculus and to correspond to the eta rules of the other two calculi. We prove that λσ and λse as well as λσ and the suspension calculus are non-comparable while λse is more adequate than the suspension calculus in simulating one-step beta-reduction. After defining the eta-reduction rule in the suspension calculus, and after comparing these three calculi of explicit substitutions , we then concentrate on the implementation of the rewrite rules of eta-reduction in these calculi. We note that it is usual practice when implementing the eta rule for substitution calculi, to mix isolated applications of eta-reduction with the application of other rules of the corresponding substitution calculi. The main disadvantage of this practice is that the eta rewrite rules so obtained are unclean because they have an operational semantics different from that of the eta-reduction of the λ-calculus. For the three calculi in question enlarged with adequate eta rules we show how to implement these eta rules. For the λse we build a clean implementation of the eta rule and we prove that it is not possible to follow the same approach for the λσ and λsusp. (shrink)

This paper makes the claim that the overall structure of Plato’s Laws follows the principle of indirect access to the knowledge of human soul, which consists in the understanding that a philosophical approach to the soul is only possible initially through an image of it. The structure of the Laws can be interpreted as a movement towards the soul’s interior, beginning with the famous image of the puppet. According to this image, the movement opens with the analysis of the non-rational (...) elements of the soul, which are capable of an harmonic relation with the rational element, and advances bit to bit to the rational or epistemic element. The political necessity of undertaking the dialectical investigation in order to attain a philosophical knowledge of the human soul and its specific excellence appears only at the end of the dialogue. In this way, the structure of the Laws dramatizes the progressive birth of philosophy, conceived as the dialectical investigation of the unity of virtue, starting from the initial understanding of the human soul contained in the myth of the puppet. Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

We try to find music in everything that permits encoding, insist on giving it a value or precise coordinates in documents, files or more recently, in codes and networks, but there will always be something in music that escapes from language. In this paper I explore some of the moral issues that could emerge from the creation of human–nonhuman chimeras capable of human gamete production and human pregnancy. First I explore whether there is a cogent argument against the creation of HNH-chimeras that could produce human gametes. I conclude that so far there is none, and that in fact there is at least one good moral reason for producing such types of creatures. Afterwards I explore some of the moral problems that (...) could emerge from the fact that a HNH-chimera could become pregnant with a human conceptus. I focus on two sets of problems: problems that would arise by virtue of the fact that a human is gestated by a nonhuman creature, and problems that would emerge from the fact that such pregnancies could affect the health of the HNH-chimera. In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

The use of technologies like artificial intelligence can drive productivity growth, efficiency and innovation. The goal of this study is to develop an anomaly detection method for locating flaws on the surface of sandwich panels using YOLOv5. The proposed algorithm extracts information locally from an image through a prediction system that creates bounding boxes and determines whether the sandwich panel surface contains flaws. It attempts to reject or accept a product based on quality levels specified in the standard. To evaluate (...) the proposed method, a comparison was made with a sandwich panel damage detection method based on a convolutional neural network and methods based on thresholding. The findings show that the proposed method, which is based on an object detector, is more accurate than the alternatives. The characteristics of the model, which can reject or accept a product according to the standard and limit allowable manufacturing flaws to obtain a quality product, also enable this system to improve industrial standards for producing sandwich panels while increasing speed. The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)
